Mississippi General Power of Attorney Form

Mississippi general power of attorney form is a document that individuals can use to appoint a representative (called an “attorney-in-fact”) to make financial decisions on behalf of the individual (the principal). The attorney-in-fact will be authorized to conduct real estate transactions, manage investments, operate businesses, file taxes, and perform any other financial management tasks approved by the principal. This contract remains active and is only voidable upon the death or incapacitation of the principal, provided a new power of attorney is signed or a revocation form is authorized.

Mississippi Durable Power of Attorney Form

Mississippi durable power of attorney form authorizes an individual to manage the principal’s financial affairs if the principal becomes incapacitated and unable to do so themselves. Ideally, the representative should be available locally and be able to deal face-to-face with banks, government agencies, creditors, and debtors on the principal’s behalf. An alternative or secondary agent should also be selected in case the first choice turns out to be unavailable when needed

  • “Durable” Definition (§  87-3-101) –  A durable power of attorney is a power of attorney by which a principal designates another his attorney in fact in writing and the writing contains the words “This power of attorney shall not be affected by subsequent disability or incapacity of the principal, or lapse of time,” or “This power of attorney shall become effective upon the disability or incapacity of the principal,” or similar words showing the intent of the principal that the authority conferred shall be exercisable notwithstanding the principal’s subsequent disability or incapacity, and, unless it states a time of termination, notwithstanding the lapse of time since the execution of the instrument.

Mississippi minor power of attorney is a legal document that delegates certain guardianship powers over a minor child to a designated representative. This form must be completed by one or both of the children’s parents or guardians. The guardian will have the authority to make decisions regarding matters such as education, healthcare, travel, and other similar issues. They do not have the authority to consent to major life decisions such as marriage, adoption, abortion, and termination of parental rights. This power of attorney form is only effective for a period of up to one year.
